These terms apply to your use of this website and to services provided by Freqxency Spark ("Spark", "we", "us"), an ad content studio based in Los Angeles, California. By using the site or our services, you agree to these terms. A signed proposal or agreement with us takes priority over these terms where they differ.
We make video ads, image ads and social content from footage and materials you provide. We do not run ads, manage ad accounts, set budgets or set marketing strategy. The number of ads, delivery schedule and rounds of changes for each plan are described on our pricing page and in your agreement.
The Pilot is a one-time project paid in advance. Monthly plans are billed in advance each month and start with a two-month minimum. After the minimum, you can cancel anytime by telling us at least 30 days before your next billing date. Fees already paid are not refundable, except where required by law.
You keep ownership of the footage, photos, logos and other materials you send us. You confirm you have the rights to share them and for them to appear in ads, including permission from any people shown. You give us permission to use these materials only to make your ads.
Once a delivery is paid for in full, you may use the finished ads for your business, on any platform, without time limits. We may show your ads in our portfolio only with your permission. Music, fonts, stock footage or AI voices may come with their own license terms, which we'll tell you about.
We commit to the number of ads, their quality and on-time delivery. Ad results also depend on your product, offer, budget and how the ads are run, so we do not guarantee specific results such as sales, conversions or return on ad spend. Past results shown on this site are examples and do not promise future results.
We keep your materials, business information and results private and only use them to provide our services, unless you give us permission or the law requires otherwise.
You are responsible for reviewing and approving ads before they run, and for making sure the claims in your ads are accurate and follow the rules of each ad platform and applicable law.
To the extent allowed by law, our total liability for any claim related to our services is limited to the amount you paid us in the three months before the claim. We are not liable for indirect or lost-profit damages.

These terms are governed by the laws of the State of California, and any disputes will be handled in Los Angeles County, California.
